1. Introduction

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”) and DVV Global Pvt. Ltd., operating under the brand name MrHomeDelivery (“Company”, “we”, “us”, “our”).

By accessing or using our website, mobile application, or any related service (“Platform”), you acknowledge and agree that:

You have read and understood these Terms.

You accept and agree to be bound by them.

You consent to the policies referenced herein (Privacy Policy, Refund Policy, Merchant Policy, Rider Policy).

If you do not agree to any part of these Terms, you must immediately discontinue using the Platform.

2. Scope of Services

MrHomeDelivery operates as a technology intermediary under the Information Technology Act, 2000, providing an online marketplace that:

Enables users to place orders for food, groceries, and general goods from third-party merchants;

Connects users with independent third-party delivery partners (“Riders”) for fulfillment.

MrHomeDelivery does not manufacture, prepare, pack, or supply any goods directly. All responsibility for products remains with the respective merchant.

3. User Account & Eligibility

Users must be 18 years or older and legally competent as per the Indian Contract Act, 1872.

Users must provide accurate information during registration and are responsible for maintaining confidentiality of their login credentials.

Any suspected fraud, misuse, security breach, identity misrepresentation, or violation of law may result in account suspension or permanent termination without notice.

Users are responsible for all activities conducted through their account.

4. Orders, Pricing & Payments

All prices are displayed in INR and inclusive of applicable GST unless stated otherwise.

Payment options include UPI, debit/credit cards, net banking, mobile wallets, or COD (subject to availability).

Once an order is confirmed, it cannot be modified, and cancellation is subject to the Refund & Cancellation Policy.

MrHomeDelivery is not responsible for:

Price changes made by merchants,

Out-of-stock items after order placement,

Errors in menus uploaded by merchants.

5. Cancellation & Refunds

Cancellations and refunds are governed strictly by our Refund & Cancellation Policy, which forms part of these Terms.

The Company reserves the absolute right to approve or deny refund requests based on internal verification and evidence.

6. Delivery & Fulfillment

All delivery times displayed are estimated and subject to factors beyond our control such as traffic, weather, merchant preparation time, and rider availability.

MrHomeDelivery makes reasonable commercial efforts to ensure timely delivery but is not liable for:

Delays due to unforeseen factors,

Inaccurate delivery location details provided by users,

Merchant-caused delays.

Risk passes to the user once the order has been delivered to the provided address.

7. User Conduct, Reviews & Content

Users may post reviews, ratings, or feedback on the Platform.

Users agree not to post:

Defamatory, abusive, misleading, obscene, or unlawful content,

Content violating third-party copyrights or trademarks.

MrHomeDelivery reserves the right to:

Remove any content at its sole discretion,

Report unlawful content to authorities under IT Act, 2000 and applicable rules.

8. Limitation of Liability

MrHomeDelivery is an intermediary under Indian law, and therefore:

Not liable for merchant products

We are not responsible for:

The quality, taste, freshness, hygiene, quantity, or safety of goods supplied;

Any health issues, allergic reactions, or adverse effects.

Users must verify ingredients and allergy information directly with the merchant.

Not liable for delivery partner incidents

Riders are independent contractors, not employees.

We are not liable for any loss, damage, accident, theft, injury, or fatality involving a rider during delivery operations.

Riders are responsible for insurance, vehicle safety, and compliance with traffic rules.

General limitation

To the maximum extent permitted under Indian law:

MrHomeDelivery’s aggregate liability for any claim shall not exceed the total order amount paid by the customer for the disputed order.

9. Intellectual Property Rights

All trademarks, logos, service names, proprietary content, software, and design elements belong exclusively to DVV Global Pvt. Ltd.

Unauthorized use, copying, distribution, reverse engineering, or reproduction is strictly prohibited and may lead to legal action under the Copyright Act, 1957 and Trade Marks Act, 1999.

10. Data Protection & Privacy

We process your personal data in accordance with:

Indian IT Act, 2000,

Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and

Our Privacy Policy.

We do not sell or misuse your data and only share it with:

Merchants for order fulfillment,

Delivery partners for order delivery,

Law enforcement when legally required.

11. Suspension & Termination

We may suspend or terminate service access without notice if:

The user violates these Terms,

Fraudulent or unlawful activity is detected,

Required by law enforcement or government order.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

All disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts at Hyderabad, Telangana.
